Some of My Choices for the GREAT Election of New Albany

Yes, it is now upon us -- Election Day. Seeing there is a lot of information still needing addressed so voters can make an informed decision...thus, the following:

Freedom of Speech is so right about their description and actions of the Scharlow Family.

From insisting on voting for "Vote For Scharlow" t-shirts inside the polls (against all election laws), to the fact they have never felt like playing by the rules (as evidenced by their snubbing of the Board of Works) and how there is no sidewalk now on Main Street by their business; how they can even consider they are not part of the "historic fringe area" and build that monstrosity they are building between a railroad track and a flood wall; is beyond our imagination as a majority of neighbors on Main Street. They are definitely in the minority on these issues.

And yes, FOS, they did file bankruptcy and hid assets within their children's names. Ask one of their old neighbors about their kids drinking and putting one of their cars through the neighbor's fence into their property...no -- according to them the car rolled sideways into this neighbor's property.

Yes, I and others feel they think they are above the rest of us. All of Main Street disagreed with their wishes, but for one; and only that one was listened to -- they didn't have a mansion who's best side is on the River's side and they do not have to look at what we consider a monstrosity being built.

When they obtained 600 E Main Street, they were suppose to put the "old, original" glass in the windows. Not them, cheap knock offs.

We had to have stained glass windows put in our kitchen just so we can't look at what they think they are "creating". Little does the one family who supported same realize it will depreciate in about 20 years and we will have a slum in our back yards. Thank you for your "progressive" thinking.

It is funny how the one person who said okay to this development can't really see what is out their back door; because they have a huge Magnolia tree and other things that block their view; but it certainly doesn't block the other neighbors around them. Who cares -- they love the Scharlows.

Who cares that even Doug England says Scharlows knew they were selling that Tumblebus location to a porn shop? England tried opening something along the same lines during Overton's administration -- but, because of the City's resistance and our nuisance law -- he paid big bucks to get out of same and save his name. He (Doug England) maintains SCHARLOWS knew they were selling out to a porn shop and I say SHAME ON THEM.

One of the more interesting issues about the Scharlows is when they tried forming their own church and they put this church inside where Tumblebus (now the DVD shop is). Every time I went past same I just kept thinking...what a doozy kind of tax scheme being run there!

Yes, let's talk about the Grand and their tax abatements they received which required they hire so many people, etc., etc.,. Their kids worked for them. When the remodeling was done for the Grand -- the State came in because of all of the asbestos and they were using people off the street to tear down who had no idea what they were being exposed to. State paid a visit to them; yet we still don't know where they deposited all of their waste. If they really did rent those City trucks (huge dump trucks) out for $60.00 a week; hey, I want to rent one -- I could make a bundle of monies, too.

Changing the subject -- I am so thankful the Council voted for the new redistricting plan 7-2. Yes -- go for it Randy Smith (as quoted in the CJ) -- we'll see you in Court, but it may not be as you perceive.

This was an illegal meeting held where Messer, Crump, Zurschmeide and the Mayor attended, along with the Plaintiffs, coming up with this absurd Consent Decree (my opinion).

The City Clerk has admitted there was no legal notice posted for public, and the Judge ordered all meetings to be held with legals posted for all of the public to attend.

Sounds like "Contempt of Court" to me. We will be in touch with the Public Access Counselor, and yes, Mr. Smith -- you will be lucky you do not see a bunch of taxpayers in Court suing you FOR THIS MONEY you think you are worth. Pay your own legal bills.

For you, Jack Messer, you will never realize how many votes this issue has cost you. You didn't have a dog in the fight (you represent the entire City -- what do you care about districts)?

It's going to bite, and bite hard. Besides, being a Council person and a Police Officer is considered by the Attorney General of Indiana to be a dual lucrative position and illegal at that. You made your bed...we'll see what comes of it. This Dem has a problem with you -- but I guess you can tell that from this posting.

As a good Democrat, who doesn't change their colors and switch back and forth between parties; I will publicly say who I think is worthy of office (and no, I don't care what most of you think) -- it's my opinions -- and mine alone.

Mayor -- Randy Hubbard
City Clerk -- Marcey Wisman
Third District -- Steve Price
At Large Candidates -- John Gonder, Kevin Zurschmeide and Richard Berryman.

One thing most people in town know about me -- I vote for the person...too many Republicans running around in Democrat clothing; but I at least am educated enough to know who is who and who stands for what.

Bring on that election. It's cost our family over $8,000.00 in property damage because of how we stand and the problems we have had with the "bad boys" next door; I have my faith...good will come from this election this time.

If I didn't have my faith -- I wouldn't have anything.

To each his own and may the best person win.

VOTE, PLEASE, TUESDAY, OR BEFORE -- DOWN AT THE CLERK'S OFFICE...VOTE...VOTE...VOTE.

TIME FOR CHANGE, and we actually have a chance this time. Hurrah for the citizens, taxpayers and voters. Get the VOTE out.

It was noted in the Tribune that Messer, Crump and Zurschmeide had signed that latest version of the consent decree along with the Mayor.

Does anyone know which Indiana Code Law requires a public notice to be posted when council members meet, discuss and sign resolutions or documents ? Was their meeting and
signing of that document illegal ?

Who will look into this ?

When did Messer do this?

It was in the Judge's Orders that all discussion, which would lead to the Consent Decree the Plaintiffs and the 3 Council people came up with, HAD TO BE OPEN TO PUBLIC WITH LEGAL NOTICE FILED; else how would we, the people, know of such meeting?

New Albanian is maintaining I am a liar about the Judge decreeing this "thang" they don't like which I am questioning. As I'm happy with Council's actions; I'm not too worried about how some of the Plaintiffs feel........if you know what I mean.

Just a reminder about a little incident someone keeps bringing up about Randy Hubband.
Just a small part of a Tribune letter Oct. 30, 2007 from Bob Snook:
“I discovered three basic facts about this incident:
• Mr. Capehart got everything he was entitled to under Federal Law;
• Floyd County Police Policy was strictly followed by both the Sheriff’s Department and Floyd County Attorney;
• Mr. Capehart resigned on his own accord after six months upon returning to his position with the Floyd County Police Department after ending his military duty.”

Randy Hubbard is an honorable man. Do a favor for yourself and New Albany --- VOTE FOR RANDY HUBBARD!!!

Sorry Dem, but I had a real hard time getting past freedom of screech is right.

As for Jack, he has been a serving this community nearly his entire adult life. Officer Messer is one of our finest policemen, and a good man. And as you say, you should vote for the man, not the party affiliation.
I do not agree with 11th hour slamming regarding irregularities, or illegal issues, for if it was bothersome enough to mention NOW, just days before the election, why has it not been bothersome enough to investigate during his years of service to all of us in two positions.
We have had many instances in this city of dual service, in the past, in most certainly will again in the future.
What sets persons like Jack apart from about 90% of the rest of us is the fact he cares about our city, and he not only is vocal about it, but he puts everything on the line for it, his life included.
JAck has the support of not only me, by my wife, and my entire family and friends, on all sides of the political isle.

Everyone has their own choices, hey Csd619? Glad to hear what you think and feel...I've had some experiences I'd rather not go into about same. Let's just say, they were not pleasant.

New Albanian, if there was not a meeting, how did the Plaintiff's and Messer's resolution get drawn up and by who; insisting upon web pages, a committee being formed consisting of the Plaintiffs, demand for a legal assistant, etc.?

It just appeared out of the clear blue sky, or what?

I don't care, and I'll just flat out tell you, what you think. This is not false information, and I think it will come out at the next City Council meeting.

I'll be the one with the mistletoe tied to her belt loop in the back, when it is declared publically in the meeting...I stand by my statement. And you, you are welcome to call me a liar all day long.

Csd619 -- Nothing personal about waiting until the last minute and putting out my selections for voting. After all of the personal property our family has had destroyed because of this election -- and those associated with same, I do have my reasons.

The posting is simply my opinion and everyone has one of those - hey?

give em hell Yvonne, I agree with you on Messer and those whiners who think they should have the authority of the city council, what really steams me is Messer cost taxpayers by using Ulrich to draft that self serving resolution for the pointy heads who think they should redraw the districts.

We usually disagree butI am with you this time.

As a citizen, Anon, do we know Ulrich worked on it, without the other Council members knowing? Something tells me to look at Shane Gibson...

No one wants to tell us, the people, what is really going on with this group and the true agenda; first complaining wanting it done now and then demanding in their "Consent Decree" it be delayed until next year Council is seated. Unlogical the way I compute information parlayed to me via different reporters, sources, etc.

My problem started with Messer when we all met about a "Code Enforcement Officer"; and various neighborhood groups and individuals attended.

Do you remember us asking for the help from the Police in removing all the junked cars from the slum properties? He looked straight at us and asked us if we were going to be "nimby" (not in my back yard)?

The then President of MSPA responded to him in kind he would think the City owned enough Industrial/Business property one could be placed there and not in anyone's back yard.

To us, the City did not even need to go into having a tow-in lot; there are wrecker services and lots like that which already exist. Why re-invent the wheel?

In the past couple of months, my husband and his crew tried painting the side of our house at the top over the power lines on the left side which faces the street. We received permission from one of the owners (Mr. England) to place a ladder there for a short period of time in order to do same.

The police were called upon my husband, and the first "set" of police were nice and kind and felt there was nothing being done wrong; and why would they object? It helps their property values, duh.

Anyways, after the first set of police left, two of the other owners showed up in their SUV, threatened to run over one of my husband's employees; then looked my husband straight in the eye and said he was calling Messer.

The next thing we know, another "set" of cops showed up and we were threatened to be locked up for "criminal trespassing". Thus, we have not been able to finish our house.

We could tell you more, like the $7,000.00 worth of property damage done to our vehicle, etc., and the involvement of the players; but some things we just have to settle -- I guess -- in a Court of Law.

As I ran against England, without asking anyone for a dime; and as I ran against Garner and Overton (because England had put Garner up), I again ran without asking anyone for a dime.

As a person who has been there and done all of that -- who else can I vote for? A man of few words; that means lots of action. Integrity, and lots of it. A friend of mine acted amazed the other day and said you mean we still have people around like that? Says volumes....

Peace, while I wait on New Albanian to call me a liar again. BTW, for those of you who wish I would post his comments so you can read same -- sorry. He's acknowledged...his venomous words and hook phrases really have no place here (oh, and those pet 16th century or whatever names he can come up with, pshew).

There is one more question I have --has the Gang of Four morphed into the Gang of Seven on a certain few?

Imagine that. Wonder what kind of costumes those seven will wear?

Another thing, there is going to be a bar tour of all the bars in Floyd County (I am not sure of the date) and will include all the bars in the County and City and ends up at Hugh E. Bir's at 8:00 PM. This ought to be a good time for all of us to drink one together and shake hands. Great music at Hughie's.

I would be interested in clarification as to whether or not it is porpusely insinuated that the NAPD was responsible for $7k worht of damage to personal property in retaliation for a personal vendetta regarding where a ladder was set up to do some painting. At least that is how it reads to me.
I get the feeling that the dirty politics of this election has spread some pretty venomous cancer through out our little blog world. And I am afraid it is an illness that may not be able to be cured this time around.
I have done my civic duty and voted, and encouraged all of those who live around me to do the same, even gave a ride or two for those who needed to get registered in our district and had no means of transportation.
As far as politics and all of the baggage that goes along with it, I think the time has come for me to gracefully bow out of city wide politics and go back to the macro picture of my own neck of the woods.
Things are once again falling apart around there, with not many people stepping up to the plate to do what needs to be done.

To be truthful, I do not know. Being in Hugh E. Bir's one night, word was sent down through Ginkin's brother saying, quoting Messer, our truck had the back and front windshields taken out as a "political hit". As I can't believe the source, you can only imagine the reaction I had when the word was sent down the bar.

Don't know I have ever shown my anger as I did that night. As I chewed Jerry Ginkins up one side an down the other, telling him if he wanted to run my personal business and seemed to know all about it, talk to me about it to my fact, without sending someone down to tell me.

He never would. He turned his back to me so I could see his gun tucked in, and then his body guard stepped in with his back to me.

As I was so angry, which doesn't justify my actions either, I literally danced down the bar to get up in his ear. If you have something to say, say it to my face...don't send some punk down to say Messer said my truck was destroyed as a political hit. Tell me to my face -- that's all I asked of Jerry Ginkins...tell me what you sent someone down to tell me...and you know he wouldn't.

But, what does it matter? No one seems to care, and I guess that's all right, too.
